RULES, REGULATIONS AND RESTRICTIONS OF THE FERN MEADOWS HOMEOWNERS ASSOCIATION

IIf you plan on buying a home or renting a home in Fern Meadows you should make sure that you are familiar with the governing documents of the Homeowners Association (HOA). The HOA expects both the renter and homeowner, to abide by the governing documents. Homeowners are responsible for tenants' violations. The HOA has the following basic set of governing documents (listed in order of hierarchy) that dictate how this HOA may be governed:  

  1. Federal and state law - Unless the statute defers to the association's documents.
  2. Declaration of Covenants, Conditions & Restrictions (CC&Rs)- Contains the rights and responsibilities of each member and the responsibilities of the HOA to its members. Information about architectural restrictions, property use restrictions, property maintenance standards, and more.
  3. Articles of Incorporation - Includes basic information about the HOA including the name of the association, its location, and the purpose of the association.
  4. Bylaws - Set out the technical rules and procedures for things like voting, the election of directors, and term limits.
  5. Rules and Regulations- Details how the CC&Rs are interpreted and implemented.

These documents are legally binding based on the implied contractual agreement as a homeowner member of the community. Therefore, it is very important that prospective buyers carefully review the terms of each of these documents because buyers will be contractually bound by them once they acquire ownership of the property. Violating the terms may also constitute a breach of contract.

RULES & REGULATIONS (these are in addition to the Covenants, Conditions and Restrictions)

All fences must comply with all applicable sections of our Governing Documents.


The finished side of the fence must face the neighboring properties.


All fences shall be maintained by the Lot Owner and kept in good order and repair.


All fences must be kept mold, mildew and otherwise growth free.


Perimeter fences of the development are required to be maintained by the lot owner, and if replaced, must comply with all applicable sections of our Governing Documents and these Rules and Regulations.

LAWN & LANDSCAPING CARE

All lawn areas shall be kept mowed and shall not be permitted to grow beyond a height of six (6) inches.


All lawn areas shall be edged and shall not be permitted to protrude onto any paved surface.


Trees must be pruned and trimmed so they are at least eight (8) feet above the sidewalk.


Trees must be pruned and trimmed to prevent damage to buildings, roofs, fences, walls, pool enclosures.


Dead limbs and palm fronds must be removed.


Lawn clippings or waste must NOT be swept or blown into the street, storm drains, drainage easements, or retention ponds.


Dead shrubs, hedges, and plantings, must be removed and replaced similar per our Governing Documents.


All Lots will be inspected for anthills routinely and exterminated as needed.


All planting areas, shall be kept covered with a landscaping ground cover material, as to not have areas of exposed dirt. Material may include, but is not limited to, mulch, rock, or shredded rubber.


All trees, shrubs, hedges, and plantings in all plantings areas must be kept pruned as to keep a uniform and pleasant appearance and trimmed in to height requirements per our Governing Documents

STUCCO, GARGAGE DOOR, FRONT ENTRY DOOR, SCREEN ENCLOSURE MAINTENANCE

All dwelling stucco cracks larger than one-half (½) inch wide and twelve (12) inches in length must be repaired and painted to match the current color of the dwelling stucco.


The garage door must be replaced or repaired if there is a dent larger than six (6) inches in diameter or any malfunction which prevents proper closure of the garage door.


All dwelling stucco must be kept mold, mildew, other growth free and cleaned of excessive dirt.


All screen enclosures (pool, front, patio) must be kept in good order and repair. Any screening damage with more than a four (4) inch by four (4) inch tear requires replacement of the entire screen panel.

SIDEWALKS, DRIVEWAYS, CURBS

All cracks in driveways and pathways (walkways) leading to dwelling (entry doors), larger than one-half (½) inch wide and twelve (12) inches in length must be repaired.


All sidewalks, driveways, pathways (walkways) and curb areas must be kept mold, mildew, other growth free and cleaned of excessive dirt.


Weeds must be removed from cracks in sidewalks, driveways, pathways (walkways), and curb areas.


Lawn clippings and waste must be removed from driveways, sidewalks, and curb areas upon completion of lawn work.

ROOFING AND GUTTERS

Any loose or missing shingles must be repaired within a reasonable time of notice, but may not exceed more than 90 days without written consent form the BOD.


Any loose or damaged gutter material, to include downspouts, must be removed or repaired within a reasonable time of notice, but may not exceed more than 90 days without written consent from the BOD.


All roofing material, to include rain gutters (if installed), must be kept mold, mildew and other growth free.

There shall be no parking on sidewalks.

Notwithstanding the provisions of Article III, Section 14. Parking, of the Declaration, Covenants, Conditions and Restrictions; boats, motor homes, watercraft, campers, travel trailers and similar recreational vehicles may be temporarily parked for the purpose of loading and unloading not to exceed a 48 hour consecutive time period. Parking of boats, motor homes, watercraft, campers, travel trailers and similar recreational vehicles shall not obstruct the flow of traffic or block driveways or sidewalks at any time.

There shall be no parking on any grass area, to include any Lot, easement, or community area within the development.

There shall be no parking between the traffic islands on Cressa Circle.

There shall be no parking in the utility maintenance concrete slab located at the front of the development.

WASTE RECEPTACLES-TRASH

Waste receptacles, when stored outside, will be placed on the either side of the house when not in use. Waste receptacles are not to be stored in front of houses at any time.


Waste receptacles are to be placed on the curb or end of driveway the evening prior to the scheduled pick-up day only.


Waste receptacles must be removed from the curb or end of driveway by the end of the evening the scheduled day of pickup.


Waste receptacle will be placed a minimum distance of five (5) feet (side of receptacle) from mail boxes and maximum of six (6) inches (back wheels) from the curb or end of driveway.


Waste receptacle are to be kept in good repair at all times.


Oversized trash pickup items may not be placed curbside for more than one (1) week.

During winds, greater than 50 knots, all waste receptacles will be stored in garages or behind fence enclosures.


During winds, greater than 50 knots, no over-sized trash pickup items are allowed curbside.

EXERIOR DOORS AND WINDOWS

All Hurricane “Storm Shutters”, to include, but not limited to, clear Lucite, metal panels and wood, must be removed within fifteen (15) days after the threat of storm.

HOLIDAY DECORATIONS

Residents who put up holiday decorations must take them down no later than 30 days after the holiday has passed.

BREVARD COUNTY ORDINANCE REGARDING HURRICANE SHUTTERS:  

All Hurricane “Storm Shutters”, to include, but not limited to, clear Lucite, metal panels and wood, must be removed within fifteen (15) days after the threat of storm in accordance with Brevard County Ord. No. 2011-33, § 3, 10-4-1,Sec. 22-278. - Maintenance standards and requirements (e)(9):
